These Terms of Use govern your use of the Sydney Opera House Website. Your use of this website means you accept these Terms of Use. “You” means the website user and “we” or “us” means the website owner, The Sydney Opera House Trust.

Attendance at an event or performance is subject to the General Terms and Conditions for Tickets and Events and any other terms and conditions notified at the time of ticket sale.

1. Intellectual Property Rights

The material on this website is protected by copyright. You may use it for your personal and non-commercial purposes only. You must not otherwise use, copy, modify, transmit, store, publish or distribute this material without written permission from us.

You must not use any logos or other trade marks displayed on this website, whether registered or not, or modify them in any way without written permission from us or the lawful owner.

2. Content & Service

While we aim to ensure all information on this website is up-to-date, details may change from time to time.

We do not guarantee uninterrupted, fault-free or error-free service.

This website may contain links to other websites or content. We do not guarantee that the links, or the websites or any content to which they link, will be functional, accurate, secure or up-to-date. The links or other content should not be taken as our sponsorship or endorsement of goods or services provided by third parties.

3. Security & Privacy

Competition Terms and Conditions

SYDNEY OPERA HOUSE INSIDER COMPETITION TERMS AND CONDITIONS

  1. Information on how to enter Sydney Opera House INSIDER Member competitions and the prizes form part of these Terms and Conditions of entry. Participation in an Sydney Opera House INSIDER Member competition is deemed acceptance of these Terms and Conditions.
  2. The Promoter is Sydney Opera House Trust, Bennelong Point, Sydney NSW 2000. ABN 69 712 101 035.
  3.  Entry is open to current Sydney Opera House INSIDER Members at the date of the relevant INSIDER email setting out the competition details. Employees of the Promoter and their immediate families, associated agencies of this promotion and companies associated with this promotion are not eligible to enter the promotions.
  4. Entry for Sydney Opera House INSIDER Member competitions requires entrants to be at least 18 years old. If you are under 18 years of age, you are not eligible to enter.
  5. Sydney Opera House INSIDER Members, who have previously won an INSIDER competition prize within the last 3 months, are not eligible to enter.
  6. The competition commences on the specified date and will close at Midnight on the end date specified within the Sydney Opera House INSIDER Member email.
  7. Each email entry must follow the format of the competition requirements detailed in the Sydney Opera House INSIDER Member email and must include Membership number and Name to prove validity of Member.
  8. Each Sydney Opera House INSIDER Member can have one entry into the competition, unless otherwise stipulated within the Sydney Opera House INSIDER Member email. However, the Promoter reserves the right to disqualify any incomplete or automated entries. Multiple entries from the same IP address, same email address or from automated competition entry services are invalid.
  9. The winning entry/entries will be randomly drawn from all eligible entries received by the closing date.
  10. The winning prize/s and their estimated value will be detailed within the relevant INSIDER email describing the competition.
  11. The Promoter’s decision in relation to any aspects of the competitions are final and binding on every person who enters and no correspondence will be entered into.
  12. The winner/s will be notified by telephone, email or via standard post and their Membership name and suburb will be published in the next Sydney Opera House INSIDER Member email.
  13. The value of offered prizes stipulated in INSIDER competition;

  14. Prizes are not redeemable for cash.
  15. The Promoter, and companies associated with this promotion, take no responsibility for prizes damaged or lost in transit. If for any reason this promotion is cancelled or is not capable of running as planned, due to an intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.
  16. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the Prize.
  17. The personal information you provide in entering this competition will be used to conduct the competition.   1. Information on how to enter and the prizes form part of these Terms and Conditions of entry. Participation in this promotion is deemed acceptance of these Terms and Condition.

  3. Entry is open to residents of Australia over the age of eighteen. Employees and their immediate families of the Promoter and agencies and companies associated with this promotion are not eligible to enter the promotion.
  4. The competition commences on 1 July 2015 at 00:01 Australian Eastern Daylight time (AEDT) and will close at 1:00 pm Australian Eastern Standard time (AEST) on 30 June 2017 (Term).
  5. To enter the competition, participants must pay on with their MasterCard or MasterPass wallet when purchasing Sydney Opera House Tours or Tickets.  Purchases can be made online from sydneyoperahouse.com website or app, over the phone or in person.  An entrant’s full details including name, address, phone number and email address must be given at the time of making the purchase. 
  6. Anyone using their MasterCard or MasterPass wallet to pay in this way during the Term will automatically be entered into a monthly draw to win a $500 Sydney Opera House voucher.  Each monthly draw will consist of entries received during the period which starts from the later of (a) the commencement date of the competition; or (b) 1:01pm on the Monthly Draw Date for the preceding calendar month,  up until the earlier of (c) 1pm of the relevant Monthly Draw Date; or (d) the competition close as set out in clause 4 above.  To be clear, each monthly draw is a discrete draw and entries from preceding calendar months are not included in that calendar month’s draw. 
  7.   9. The monthly winner will be notified by email and telephone and will be published on the Sydney Opera House website by the first Wednesday following each Monthly Draw Date. If there are any unclaimed prizes three months after the final draw, the Promoter will seek permission from the relevant authority to conduct a redraw.

CREATIVE LEARNING TERMS & CONDITIONS

  1. All bookings are subject to the Sydney Opera House Ticket Terms and Conditions.
  2. If a booking is made on behalf of a school or organisation, then that entity and the person nominated as that entity’s responsible representative must ensure payments are delivered by due dates specified on invoices.
  3. Invoices for a non-refundable 25% deposit will be issued upon making a reservation. Payment of the 25% deposit is due within ten (10) business days from the date of issue. 
  4. Final ticket numbers must be confirmed to the Sydney Opera House Creative Learning department no later than nine (9) full School Weeks prior to the event. If there are alterations to the booking, a new invoice will be issued outlining the changes and may require adjustments to applicable deposits. 
  5. All bookings must be paid in full six (6) full School Weeks prior to the event.
  6. Any bookings made within six (6) full School Weeks to the event are considered final and full payment is required within ten (10) business days for events in less than two (2) full School Weeks, or as specified in the invoice having regard to the event schedule. 
  7. In the event that the school or organisation wishes to cancel a Creative Learning booking, written notification from the entity’s responsible representative is to be provided no later than seven (7) full School Weeks prior to the performance. Cancellation of a booking up to seven (7) full Schools Weeks prior to the performance will result in forfeiture of the 25% deposit. Bookings cancelled within six (6) School Weeks of the performance will result in forfeiture of full payable amount for the order. Bookings that have not yet been paid to Sydney Opera House will require payment in full if cancellation is within this period. 
  8. For Subsidised Digital Excursions only – these programs are free of charge. However, in view of investments in preparation and management of Subsidised Digital Excursions, failure to dial into the session, or cancellation within seven (7) days of the Subsidised Digital Excursion, may be subject to cancellation fees of up to $100. Invoices for cancellation fees are payable within seven (7) days of issue. 

Notes and definitions:

School Weeks are defined in accordance with NSW Public Schools standards. Subsidised Digital Excursions means Sydney Opera House’s program of interactive, curriculum driven lessons and tours delivered via video conferencing.

KIDS MULTIPACK - TERMS AND CONDITIONS

  1. The Kids Multipack discount applies to all Sydney Opera House Presents Kids & Families performances (excluding Circus 1903, Kids Music Cafe, The Children's Republic of Sydney and Backstage in Biscuit Land). The Kids Multipack discount does not apply to the following seasons: Storytime Ballet: The Nutcracker, Olympic Orchestra - Music for Sport, Carnival of the {Australian} Animals and The Bush Concert.
  2. To be eligible for the Kids Multipack discount: 
    a). purchaser must buy tickets to a minimum of 3 separate productions within Sydney Opera House Presents Kids & Families program (excluding Circus 1903, Kids Music Cafe, The Children's Republic of Sydney and Backstage in Biscuit Land). Does not apply to multiple tickets for the one show/production, or multiple dates of the same production. 
    b). purchaser must buy the same number of tickets for each production within the Multipack. 
    c). Tickets must be purchased by the same customer, in the one transaction.
  3. Purchaser of a Kids Multipack is entitled to one free exchange of tickets between performance dates within the season for the same production (subject to availability).
  4. The holder of a Kids Multipack may add Sydney Opera House Presents Kids & Families productions to an existing multipack at the appropriate discount. Purchaser must notify the Box Office when making this additional transaction. Additional discounts will NOT be applied retrospectively to tickets previously purchased.
  5. The Kids Multipack discount applies to the ticket price only and cannot be used in conjunction with any other offer or discount, other than the 10% discount on Junior Adventures booked online through sydneyoperahouse.com.
  6. If a purchaser buys additional tickets to a production within a Multipack, tickets are charged at full price. 
  7. All discount and package offers are limited and the offer may be withdrawn without notice. Buy early to avoid disappointment.
  8. No refunds except where mandatory under the Live Performance Australia Ticketing Code of Practice.
  9. Venues and performance times are subject to change. Please ensure all your contact details are listed in your account when you book.
  10. A transaction fee of $5-$8.50 applies to all bookings.

AIRBNB EXPERIENCES - BEST SEAT IN THE HOUSE TERMS AND CONDITIONS

  1. The sale of tickets for an Event and attendance at an Event  are subject to these General Terms and Conditions as well as any specific terms and conditions notified at the time of ticket sale.

    “Event” means a concert, show or other performance at the Sydney Opera House, or that is arranged by the Sydney Opera House, or for which the Sydney Opera House sells tickets.

    “You” means the person acquiring a ticket or seeking to attend an Event and “we” means The Sydney Opera House Trust.

    By acquiring a ticket for an Event and/or seeking to attend an Event, you agree to these General Terms and Conditions.

    By purchasing a ticket on behalf of someone else, you undertake to inform them of these General Terms and Conditions and any other terms and conditions notified at the time of sale.

    These General Terms and Conditions also apply to tickets issued by an authorised ticket seller (if any). To the extent of any inconsistency, these General Terms and Conditions, and any other conditions of sale relating to the specific Event notified at the time of sale, will prevail.

    If another company is presenting the Event, tickets and attendance may also be subject to the other presenter’s terms and conditions. Alternatively, if the ticket is for an Event at a venue other than the Sydney Opera House, attendance at the venue may also be subject to the other venue’s terms and conditions. You will be notified of this on our website with the information relating to the specific Event.

  2. Resale Prohibited

    You agree not to re-sell any tickets for profit.

    Tickets must be purchased from an authorised ticket seller and must not be included in packages or used in advertising unless authorised by us in writing.

    The Sydney Opera House is the only authorised ticket seller for Events at the Sydney Opera House, unless we specify on our website that there are other authorised ticket sellers for a specific Event. Tickets purchased from Ticketmaster Resale, Viagogo, Ticketbis, eBay, Gumtree, Tickets Australia or any other unauthorised re-seller may be cancelled without notice and/or the holder may be refused admission to the Event.

  3. Other Terms and Conditions of Sale

    We may impose other terms and conditions of sale in relation to specific Events, in which case you will be notified of these at the time of sale, including on our website with the information relating to the specific Event.

    We may impose a maximum ticket limit to specific Events. Unless otherwise specified, the maximum number specified applies to the Event or season overall, not to each performance. Tickets purchased in excess of a ticket limit may be cancelled without notice.

    Normally you may choose your preferred method of ticket delivery but we reserve the right to require you to collect tickets at the Box Office if we deem it necessary for operational reasons, for example to ensure the tickets are issued correctly.

  4. Refunds

    We will not be responsible for refunding tickets purchased from unauthorised re-sellers.

    Otherwise, you are entitled to a refund if we cancel an Event or reschedule it to a time more than 2 hours earlier or later than originally programmed and you cannot or do not wish to attend the rescheduled Event. You are also entitled to a refund if we issue a ticket to you by mistake and we are unable to provide you with the Event in question.

    If you believe an Event you have attended was not provided substantially as advertised, we will give reasonable consideration to your request for a refund. However, we reserve the right not to provide a refund:

    (a)       merely because you did not enjoy the Event, performance or venue, you arrived late or did not attend;

    (b)       if you were refused entry or removed due to your breach of these General Terms and Conditions or for the reasons described in paragraph 7; or

    (c)       if, despite our reasonable diligence, the cause was outside our control.

    If you believe you are entitled to a refund you should apply within five days after the Event’s scheduled commencement. If you do not seek a refund within a reasonable timeframe we may not provide you with the requested refund, unless required by law. If you purchased your ticket from another authorised ticket seller, you should apply to them for your refund.

    Any refund payable will be made to the original purchaser, and when practicable to the original form of payment used to purchase the ticket.

    We will not be responsible for any expenses incurred or to be incurred by you, for example travel, car parking, child care, accommodation or other goods or services, even if the Event is cancelled. You should consider whether insurance is appropriate for your circumstances.

  5. Lost Tickets

    It is your responsibility to keep your tickets safe. Replacement of lost, stolen or missing tickets may be permitted at our sole discretion and fees may apply.

  6. Changes
    While we endeavour to keep ticket-holders informed, details may change sometimes with little or no notice. For example, artists or other participants may be added, withdrawn or substituted or the venue may change.

    Despite any seat number on your ticket, we do not guarantee you any particular seat. If we need to allocate a different seat to you for operational reasons, including a change of venue, we will use reasonable endeavours to ensure it is in a location of comparable value to the seat number on your ticket.

    We make every effort to ensure pricing is correct but we reserve any rights we may have to correct genuine errors.

  7. Refusal of Admission

    We may refuse entry to an Event or have you removed from the venue on valid grounds, including if:
    (a)       you fail to comply with these General Terms and Conditions or the Sydney Opera House Trust By-law;
    (b)       we have not received payment for your ticket or you are unable to produce a ticket;
    (c)       you are intoxicated or you behave in a threatening, disruptive or offensive manner;
    (d)       you interfere unreasonably with another visitor’s enjoyment of the Event or venue or with our staff carrying out their functions; or
    (e)       as specified elsewhere in these General Terms and Conditions.

    We may need to refuse admission for safety or security reasons, in which case we will refund your ticket if it was purchased in accordance with these General Terms and Conditions.

    Unless otherwise specified, we do not provide supervision of children. All children requiring supervision must be accompanied by a supervising adult at all times and may be refused admission or attendance if not accompanied by a supervising adult.

    Latecomers may be admitted to a performance during a suitable break, which could be the first interval, if an interval is scheduled. In some cases, latecomers may not be admitted at all.

  8. Venue Requirements

    To help ensure the safety and security of the Sydney Opera House, bags and personal belongings may be subject to visual inspection.

    Umbrellas, prams, backpacks, larger bags and other items that may be hazardous or restrict the movement of visitors may not be permitted into the venue or may be required to be cloaked, depending on the nature of the Event and relevant circumstances.

    It is your responsibility to collect any cloaked items after the performance.

    Normally food and drink are not allowed inside a theatre or auditorium, unless otherwise specified.

    Other items that are prohibited inside the Sydney Opera House include, but are not limited to: alcohol purchased from outside; glass bottles; offensive signs or clothing, laser pointers; and any other items that could present a safety hazard to others or interfere with the performance.

    Commercial activity including promotions, marketing, photography and filming are not permitted at the Sydney Opera House, unless expressly authorised by us.

    You must switch your mobile phone to silent while in a theatre or auditorium or on a tour.

  9. Photographs, Recordings and Privacy

    We reserve the right to record, broadcast and/or telecast any Event at the Sydney Opera House and you consent to the use of any image or recording taken of you, and anyone for whom you are responsible, while on the premises. We are not obliged to use, broadcast or provide to you any such recording.

    We use closed circuit television (CCTV) cameras at the Sydney Opera House.

10. Liability

The Sydney Opera House will not be responsible or liable for any loss, damage or injury to the extent arising from your negligent acts or omissions, any pre-existing medical condition,   your breach of these terms and conditions, or your reliance on reviews and opinions about Events and performers.

You should make your own further inquiries before deciding whether an Event is suitable.

You are responsible for your personal possessions such as bags, mobile phones and other items you carry with you.

Our liability to you in relation to tickets is limited to the obligations specified in these General Terms and Conditions and our obligations under applicable laws and the Live Performance Australia Ticketing Code of Practice – Consumer Code.

The Australian Consumer Law provides certain statutory guarantees for consumers which cannot be excluded, for example that services will be provided with due care and skill. Nothing in these General Terms and Conditions modifies or excludes those guarantees.

11. No Waiver

We reserve the right to enforce these General Terms and Conditions if:

(a)       you have purchased a ticket to an Event in contravention of these General Terms and Conditions and you attempt to attend the Event; or

(b)       we have not enforced our rights under these General Terms and Conditions on a prior occasion.

12. Guided Tours

Without limiting any other provision, the following provisions apply to guided tours:

(a)       the tour route and access to venues, including theatres, auditoriums and backstage areas, vary depending on availability and performance and rehearsal schedules so no particular route or access is guaranteed;

(b)       ticket holders must remain with the tour guide and follow instructions;

(c)       latecomers will not be able to join a tour and their tickets will not be refunded;

(d)       there may be up to 300 stairs on a tour so flat, rubber soled shoes should be worn.

If you wish to make a complaint about our venue or services, we ask that you do so within five days after the relevant Event or issue.

FLEET FOXES “CRACK-UP” VINYL COMPETITION TERMS AND CONDITIONS

  1. Information on how to enter and the prizes form part of these Terms and Conditions of entry. Participation in this competition is deemed acceptance of these Terms and Conditions.
  2. The Promoter is Sydney Opera House Trust, Bennelong Point, Sydney NSW 2000. (ABN 69 712 101 035), (+612) 9250 7111. 
  3. Entry is open to residents of Australia (and NSW) over the age of eighteen. Employees of the Promoter and their immediate families and agencies and companies associated with this competition are not eligible to enter.
  4. The competition commences on Friday 23 June 2017 at 8.30am  Australian Eastern Standard time (AEST) and will close at 11:59pm on Mon 26 June 2017 AEST.
  5. You may only enter the competition once. The Promoter reserves the right to disqualify any incomplete or automated entries.  Multiple entries from the same IP address, same email address or from automated competition entry services are invalid. 
  6. To enter the competition, you must complete all details as highlighted in email.
  7. Prize: One copy of Fleet Foxes 2017 album ‘ Crack-Up’ for seven winners. Winner/s will be drawn at the Sydney Opera House (Level 5, 22 Pitt St, Circular Quay NSW 2000). The first seven valid entries drawn by the judges will win a prize. Judges decision is final and no correspondence will be entered into. The total value of any one prize is $50 and the total prize pool is $350.
  8. The Promoter’s decision in relation to any aspects of the competition is final and binding on every person who enters and no correspondence will be entered into.
  9. The winner(s) will be notified by email and/or telephone within two days of the prize draw. If, for any reason, the winner does not claim the prize or the contact details supplied by them were incorrect, the Promoter reserves the right to draw a second chance prize winner three months after the date of the first draw and that person will be the prize winner (unless the prize is tickets or some other perishable item).
  10. Prizes will be sent via standard post or courier to the address provided by the winner within 20 days from the close of the competition.
  11. The Promoter and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.
